By creating an account, logging in, or otherwise accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and any future modifications. Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the updated Terms.

The Platform is intended for individuals who are preparing to take the GED® exam or who are supporting others in that preparation (such as tutors and educators). You must be at least 13 years of age to create an account. If you are under the age of 18, you represent that you have the consent of a parent or legal guardian to use the Platform.

By using the Platform, you represent and warrant that all information you provide is accurate, current, and complete.

MathPath AI™ is an educational tool designed to support GED® math preparation. The Platform is provided for informational and instructional purposes only.

We make no representation, warranty, or guarantee that use of the Platform will result in passing the GED® exam or any other assessment. Academic outcomes depend on many factors outside our control, including individual effort, prior knowledge, test conditions, and official examination standards set by GED Testing Service®, which is not affiliated with MathPath AI, LLC.

GED® is a registered trademark of GED Testing Service LLC. MathPath AI, LLC is not affiliated with or endorsed by GED Testing Service LLC.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. MathPath AI, LLC is not liable for any loss or damage arising from your failure to protect your account credentials.

You may not create accounts on behalf of others without their authorization, share your account with other individuals, or use another person's account without permission.

You agree to use the Platform only for lawful educational purposes. You agree not to:

• Use the Platform to harass, abuse, or harm others
• Attempt to gain unauthorized access to any part of the Platform or its systems
• Reverse-engineer, copy, or reproduce any part of the Platform without written permission
• Use automated tools, bots, or scripts to access or interact with the Platform
• Transmit any content that is unlawful, offensive, or in violation of any third-party rights
• Interfere with or disrupt the integrity or performance of the Platform

MathPath AI, LLC reserves the right to suspend or terminate your access if you violate these acceptable use requirements.

All content on the Platform — including but not limited to lesson materials, quiz questions, AI-generated explanations, software, design, and branding — is the property of MathPath AI, LLC or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial educational purposes. No rights are transferred to you beyond this limited license. You may not reproduce, distribute, or create derivative works from Platform content without our prior written consent.

By using the Platform, you consent to the collection and use of certain information as necessary to operate the Platform, including your name, email address, and progress data (completed topics, quiz scores, and learning activity). This information is used solely to provide and improve your educational experience on the Platform.

We do not sell your personal information to third parties. We take reasonable technical and organizational measures to protect your data, but no system is perfectly secure and we cannot guarantee absolute security.

A full Privacy Policy will be published separately and incorporated into these Terms by reference when available.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, MathPath AI, LLC expressly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Platform, including AI-generated content.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MATHPATH AI, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF GOODWILL, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM.

In no event shall MathPath AI, LLC's total liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the greater of (a) the total amount paid by you to MathPath AI, LLC in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

You agree to indemnify, defend, and hold harmless MathPath AI, LLC and its members, managers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit or transmit through the Platform.

The Platform may use third-party services (such as authentication, hosting, or AI providers) to deliver its functionality. These services have their own terms and privacy policies, and your use of the Platform constitutes your acknowledgment of and agreement to interact with such third-party services as a necessary part of the Platform's operation. MathPath AI, LLC is not responsible for the practices of any third-party services.

MathPath AI, LLC reserves the right to modify, suspend, or discontinue the Platform (or any part of it) at any time, with or without notice. We also reserve the right to update these Terms at any time. When we do, we will update the effective date at the top of this page. Your continued use of the Platform after any modification constitutes your acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which MathPath AI, LLC is organized, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in that state, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.
